Another Invasive Biopsy

Katie is at M.D. Anderson early in the morning being prepared for a new invasive surgery. Surgery began about 8:30 am and lasted till about 2 pm. The plan was to make a small incision between the ribs on the left side of the upper chest and sample the tumor using a small biopsy prob fitted with a camera. Things apparently didn't go well and they ended up making a total of 3 holes between the ribs on the back. Finally the doctor makes a 5 inch incision between those same 2 ribs, collapses her left lung and reaches her hand in to feel for the area of tumor desired. The doctor removed over 90% of the thymus gland and sends it to the lab for a quick analysis.

The sample was frozen and sliced and looked at under a microscope. There was no cancer found. The entire sample will be sectioned and analysed in the next five days. We were allowed to see Katie after she woke up in the intensive care section of the hospital. Katie was burning up with fever and had ice packs on her head. She was in excruciating pain. What should have been a simple and almost painless procedure of taking a small sample with the camera probe turned into a disaster. Removing the thymus was not called for or discussed in the procedure. This was a major surgery and it turned into a disaster. Michele remained by her side in intensive care. Katie was very disappointed and broken-hearted that CPS would not allow Edward (dad) to stay in the room.

Katie Wernecke's Six Biopsy Samples Negative

Doctors at M.D. Anderson took 6 biopsy samples of the tumor on Thursday the 23rd and all were negative. Michele Wernecke was told by the doctors at the time of biopsy that: “They took 6 samples just in case two might have come back negative.” The doctors were carefully guided by a live cat scan while taking the biopsies during the procedure so they couldn’t miss and they took a lot of extra samples. Doctors at M.D. Anderson found just dead cells, scar tissue and fibers in the six biopsy samples.

Edward and Michele Wernecke say: “It is a miracle! It is the healing power of God. It is an answer to millions of prayers by caring people. Praise God.”

Now, the doctors at M.D. Anderson are not satisfied with that. They want to do a more invasive procedure on Thursday to obtain more samples. This would involve cutting her throat again and going in from the top, or cutting a portion of rib bone out and going in from the side of the chest.

Edward and Michele say: “When is it going to stop. Three surgeries in one week are too much for anyone. This surgery is not necessary and is very risky and the previous chemo treatments have weakened her immune system and blood counts. An infection at this stage could kill her.”

CPS and the State of Texas has had custody of Katie for nearly 30 days and she has received no treatments that they said were necessary to save her life and used to justify taking her from her parents in the first place. Now 6 biopsy samples were negative. It’s time to release Katie to her parents and bring her home. Edward said: “It’s time for folks to call their State Representatives, the Attorney General and the Governor of Texas and ask them to intervene to get Katie back home with her parents immediately.”

Katie is at M.D. Anderson - Update

Katie is at M.D. Anderson in Houston, Texas.

The family was able to see Katie a week ago Thursday at the Corpus Airport as she returned from Houston. Katie was surrounded by five armed guards at the airport. We all got to talk to her a few minutes.

Michele spent Monday, Wednesday, Thursday, and Friday with Katie at M.D. Anderson. Katie is really missing her home and family and friends. She is now staying in a CPS home in Houston where her own family cannot visit her. Katie's hospital room is guarded by an armed guard.

Katie is now being cared for by a team of doctors who are re-evaluating her.
She has had another CAT scan and another PET scan done. She had a bone marrow sample taken and had a biopsy on the tumor Thursday. We were told that test results will be back on Tuesday next week.

She has received no treatments of chemo or radiation as of today. Where was the urgency? Please continue to pray for Katie's complete healing and that God will continue to give her strength to endure the separation from her mom, dad, and brothers. The pain has to be unbearable.

We Never Refused Radiation Treatments

Another misconception is that we had refused radiation treatments for Katie. We never refused radiation treatments or signed anything to that effect. The doctor never even set an appointment for radiation treatments.

We asked for a second opinion because Katie had no active cancer at the time.

After the second opinion the two doctors did not even agree. Dr. Alter saying we needed radiation and Dr. Mullins saying we needed more chemo plus radiation. Two days later, thats right, just two days later, we were called by Dr. Alter's office social worker, Laura Esparza, saying we needed to decide on which doctor we wanted to go with and at that point we asked for a third opinion. It is at this point that Dr. Alter called in CPS.

We never delayed any treatments. The doctors wasted 5 weeks of time making appointments after her last chemo. We were given only 2 days to go with it or else, and Dr. Alter refused to make the referal to another doctor, and called in CPS instead.

In 1987 my 15 year old brother was diagnosed with stage II Hodgkin's lymphoma. At that time my parents took him to the best doctors and hospital in our area which was Childrens Hospital of Michigan. They recommended that he be treated with radiation and no further therapy. They never offered any other treatment options nor did they explain the risks versus the benefits of the radiation treatment. He received a course of radiation that was very difficult for him and then he was told he was in remission. He frequently went back for about 7 years for follow up exams and we were told that his cancer was cured. Three years after that he began experiencing severe headaches. For a year he was misdiagnosed with sinus infections. Then when he was 26 years old he was diagnosed with Oligodendroglioma which is a from of advanced brain cancer. A few years later he was also diagnosed with advanced thyroid cancer. Only then were we told that these cancers were the direct result of the radiation treatment that he had received for the Hodgkins. Essentially, had we been more informed and demanded other treatment options he might be healthy today. Unfortunately people have a tendency to listen to everything that doctors say as though they are "god". My parents regret not being more assertive with my brothers care. I just wanted to share my story with you because I strongly support you and your family at this difficult time. I cannot fathom why the state thinks that they should have any involvement in your care. It is simply ridiculous !!! Whatever treatment you and your parents decide to do please make sure that you research everything you can about it. Ask a million questions and demand accurate answers. Mom was a Match for Blood Transfusion

There has been a lot of misinformation floating around judging by the posts.
Katie is O+ blood type.
Michele is O+ blood type.
Edward is O+ blood type.
We are all compatable donors.
Dr. Alter never considered our religious objections at all.
Dr. Alter never did a crossmatch on Katie and Michele's blood.
Dr. Alter called in CPS to force public blood upon us. Michele consented after pressure was put upon her and fear of losing her kids.
Even without a religious objection we would have objected to the use of public blood due to safety concerns just as many of you might also have concerns.

Letter to the Editor Caller Times

Needs family

I have the deepest feelings of sadness for Katie Wernecke and her family. We, too, were hit with emotional news that our 13-year-old daughter had cancer. Decisions are thrown at you as to what could be done to save them, but no one will actually say what really needs to happen. We had full trust in the oncology department at Driscoll Children's Hospital.

Our daughter went through grueling chemo treatments and surgeries to save her life. She needed her family beside her all the way. Even though she lost her fight against cancer, her family was there to help her with the battle.

Letting strangers go through little Katie's chemo treatments really bothers me a lot. This case is not being treated seriously. This is a life and death situation. Cancer does kill. As we have witnessed in our house. That little girl needs her family now more than she will ever need them.

State overreacted

I read an article in USA Today that is very disturbing. The article states that the child welfare system removed a child from her parents when her parents refused to allow the doctors to proceed with radiation treatment for the child's cancer. I believe that should be a parent's right. This should not become a state fight. That is the problem with our country today. Government has taken all of the parental rights away from parents and our children are running wild. This is deplorable. There are other kids that need rescuing.

Court Hearing - 4pm Friday

A prelimary report from the PET scan indicated that their may be some activity returning. Our attorneys were not given a copy of the report before the hearing. Dr. Alter was at the hearing and smiling because now he could continue his treatments. Judge Lewis was not inclined to release Katie to her parents. He took Dr. Alter's recommendations to start chemo, then evaluate, then to do radiation on Katie.

No alternative treatments options were offered by the doctors here or at M D Anderson hospital. Only one doctor from M D Anderson signed their report and it was just a carbon copy of Dr. Alters and Dr. Mullins recommendations. You would have expected a team of doctors from M D Anderson to evaluate Katie with at least three doctors writing and signing the report. Yet she was examined by an intern! Hey guys, my child's life is on the line.

Katie was to remain in CPS custody. CPS now has control of Katie and is able to begin treatments.

Again it should be an issue of the parents rights to choose the treatment for their child and not the state. Katie's CASA representative and attorney Ad litem did not even take a stand to protect Katie's rights.

3 Sons Returned Home

On thursday, a team of 3 came to inspect our home. Again my basic rights were violated. I was forced to open a locked closet and office. Children had no access to this area. They really needed a search warrant. I objected, but I complied as I really wanted my boys back. The home was approved. I had to sign some papers allowing unannounced visits to the home and submitt to other intrusions into our privacy.

Friday, the children were supposed to arrive at 8 to 8:30 AM. There were press and TV crews every where waiting for the kids to arrive. They finally arrived at 9:30 PM. It was a very emotional event. It was great to have the boys home again. Thank you Judge Lewis. Our home will never be the same. We still need to get Katie out of CPS custody. We will continue to fight for her rights.

Court Hearing - Injunction

We had a court hearing before Judge Lewis in County Court of Law #5. The judge granted an injuction to stop any treatments till a new P.E.T. scan could be performed. The judge also ordered the other 3 sons to be returned to the home after a home inspection by 3 court agents on Thursday at 6:30 pm. The next hearing was scheduled for Friday the 10th at 4pm.

Michele Released From Jail

I mortgaged my home to raise the $50,000 for the bail and presented it at 11 AM to the sheriff's office. I waited for her and she was not released until after 3:30 PM. At 4 PM we were to visit our 3 sons in CPS custody. We rushed over to the CPS office on Greenwood expecting to see them. CPS refused to let us see them. We still haven't been able to see or speak to Katie.

Katie and Mother Found

After an AMBER ALERT, Katie, James, and their mother Michele were found on a ranch in Duval County, Texas by peace officers. They had no search warrant or court order. She was taken to Duval County Sheriff's Office and read her rights by a judge. CPS was called to pick up Katie and James. Kim Garcia, CPS investigator told the peace officers that "it was her weekend off and call the lady that is on call." She did want to drive all the way to Alice to pick up the children. She put us in this mess and did not care enough to come get my children. Michele was then transferred to Nueces County Jail.

CPS CAME TO GET KATIE

Child Protective Services (CPS) showed up a my door late this afternoon with an ORDER FOR PROTECTION OF A CHILD IN AN EMERGENCY AND NOTICE OF HEARING. They had orders to remove Katie and I told them she was not here. I told them I needed to have it explained to me by my attorney which I could not reach by phone even though I had his cell phone number for an emergency. I told them they needed a search warrant and they said the court order was enough. They wouldn't wait any longer and forced their way into my house and completely searched it and meanwhile CPS took pictures of everything. Katie wasn't here as I told them.

What this means is the CPS department is named temporary sole managing conservator of Katie and once they get her they will do the radiation treatments on her without her consent and without her parents consent and all this without a court hearing to determine if any of the allegations are true, which they are not, and if any of the statements by the doctors are true.

This is not medical neglect and she is not at risk of dying or injury without this treatment. I had arranged for a third opinion today with a Dr. Voorhees and her Dr. Alter knew this and ignored and did not arrange the referal as the nurse Laura Wendland said they would. I have actively sought the best treatment for Katie. We believe the radiation may not be necessary at this time. She is at risk for injury from the radiation treatments that far exceed their benefit. Reseach has shown the five year survival rate for Chemo alone to be superior to Chemo + Radiation. Believe, me I have spent much time reseaching this before reaching this conclusion.

Why are the doctors doing this, Katie appears to be part of a study where they allocate kids randomly to one treatment, say standard Chemo + Radiation, and Chemo only in the other treatment. Parents are not informed of this. They are doing research on our kids. Collecting research money from the drug companies I guess. Dr. Alter said before " I don't need your permission to do it." This is wrong. Parents (should) have a right to choose the best medical treatment for their child. Apparently not in Texas. The State (CPS) is trying to do it for my child. This is not a case of medical neglect where I have not sought treatment or refused to allow my child to be treated. She went through 4 chemo treatments and we had to watch her suffer through that ordeal and were by her side all the way, the doctor and nurses weren't there for her. Call the Hospital, demand a full investigation, go public, get tv and radio stations to pick up the story and interview the parents. We may be in jail by then, so hurry.

There is a full adversary hearing on June 15, 2005 at 10:00 AM in the County Court at Law #5 of Nueces County, in Corpus Christi, Texas. Please attend and support Katie, we need to pack the court room, I need character witnesses so I don't lose all my kids permanantly from these trumped up charges.

Yes, they took all my kids. Jonathan and Joshua and James. That again wasn't indicated by the facts, but a ploy by CPS to force us to give them Katie I suppose. Katie wasn't here, thank God, and I don't know where she is, cause if they get ahold of her they will force these treatments on her and she doesn't even want them.

We must stop this brutality and the overstepping of CPS powers and forcing kids to get treatments without their parents approval. Dr. Alter is largely at fault here because of the trumped up charges saying that she would die without this treatment. That is not true and he can't prove it. Dr. Alter can be reached at Driscoll Childrens Hospital at 361-694-5311. Call him and tell him you don't like what he did and God will punish him for it. He doesn't believe in the power of God and prayer. We urgently need a doctor that will take Katie's side.

While you are calling Drisoll Childrens Hospital call the President Rick Merrill at 361-694-5021 and voice your disapproval of Dr. Alter's treatment of Katie and involving CPS with this fine christian family. There motto is "Hope and Healing for 50 years" Katie's hope and healing is in jeopardy. She is healing just fine on her own with God's help.

CPS Takes All My Kids

CPS took my sons Jonathan (14) and Joshua (5) into CPS custody that night. I asked them to place them with their grandparents and I signed a paper to that effect. They did the background check and a home inspection. The home was immaculate. They turned the home inspection into a search for Katie. The boys were already in bed and sleeping. They did not leave the boys with the grandparents and hauled them off again in the middle of the night.

IF YOU KNOW OF A CHILDREN'S ONCOLOGIST THAT IS VERY LIBERAL IN TREATMENT METHODS AND USES ALTERNATIVE METHODS PLEASE CONTACT US AT ONCE. CALL 361-998-2021 .

We need an oncologist or doctor that takes kids and has experience with cancer as an EXPERT WITNESS against the child protective services. Someone willing to say after looking at the facts that the radiation treatments may cause more harm than good at this time and that it may not or is not necessary or prudent to treat while there is no active cancer cells.

We risk having Katie taken away from us and placed in state care and given radiation treatments she doesn't even want.

We are being charged with MEDICAL NEGLECT defined as:
  • failing to seek, obtain, or follow through with medical care for a child, with the failure resulting in or presenting a substantial risk of death, disfigurement, or bodily injury or with the failure resulting in an observable and material impairment to the growth, development, or functioning of the child.

We requested a third opinion and another PET scan to be done before Katie has any radiation done to prove whether the cancer is active at all. It has been 2 months since the last chemo and 30 days since the last PET scan. It hasn't been approved yet.

We want the best care for our Katie and we also want to protect her from harm. That is the duty of any good parents. Parents should also be able to make the medical decisions for their own children. Dr. Alter never gave us a choice or input in the treatments for Katie and he proved that when he was offered alternative solutions to a blood transfusion earlier including using blood from Katie's own mother, which was acceptable to us, which he rejected.
